Notes Les armateurs ont connaissance des circulaires restrictives d'août et octobre. L'armement négrier est signalé au ministre de la Marine par l'ambassadeur d'Angleterre, duc de Wellington. Le bâtiment est saisi à l'ancre par deux navires de guerre britanniques, alors que les conventions de paix entre l'Angleterre et la France sont en discussion. Le procès a lieu le 21 novembre 1816. Le navire est condamné comme prise de guerre, et non sur probabilité négrière. Les Anglais justifient la prise par le fait qu'il n'y aurait pas de papiers à bord avant la saisie: ils pensent cependant qu'il s'agit d'une "propriété française", donc ennemie, malgré la fin des hostilités.
